Terms of Service

1. Acceptance of Terms

By accessing and using SendLouis ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

SendLouis provides email sending services, domain verification, email template management, and related features. The Service is provided "as is" and we reserve the right to modify or discontinue any aspect of the Service at any time.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree not to:

  • Send spam or unsolicited commercial emails
  • Transmit any malicious code, viruses, or harmful content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to the Service
  • Use the Service to send phishing emails or scams

4.5. Anti-Spam and Email Marketing Compliance

You are solely responsible for complying with all applicable email marketing and anti-spam laws, including but not limited to:

  • CAN-SPAM Act (United States): Requires accurate sender information, clear identification of commercial messages, and functional unsubscribe mechanisms
  • GDPR (European Union): Requires explicit consent before sending marketing emails to EU recipients
  • CASL (Canada): Requires express or implied consent before sending commercial electronic messages to Canadian recipients

When using the Service, you must:

  • Only send emails to recipients who have given explicit permission to receive communications from you
  • Include accurate sender information in all emails
  • Provide a clear and functional unsubscribe mechanism in commercial emails
  • Honor unsubscribe requests promptly (within 10 business days)
  • Maintain records of consent and permission for your email lists
  • Never purchase or rent email lists from third parties

Violation of anti-spam laws may result in immediate account suspension or termination.

5. Email Sending Limits and Plan Features

Your account is subject to sending limits and feature restrictions based on your subscription plan:

We reserve the right to suspend or terminate accounts that exceed their limits or violate our acceptable use policies. Unused email credits do not roll over to the next billing period.

6. Payment and Billing

Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees. If payment fails, we may suspend or terminate your access to paid features.

6.5. Cancellations and Refunds

You may cancel your subscription at any time through your account settings or the Stripe billing portal accessible from your account dashboard.

  • Cancellations take effect at the end of your current billing period
  • You will retain access to paid features until the end of the paid period
  • Your account will automatically downgrade to the Free plan when the current billing period ends

Refund Policy:

  • We do not offer refunds for partial months of service
  • Unused email credits are not refundable and do not roll over
  • In cases of service outages lasting more than 48 continuous hours, we may provide pro-rata credits at our discretion
  • Refund requests for exceptional circumstances should be submitted to support@sendlouis.com and will be evaluated on a case-by-case basis

6.6. Bounce and Complaint Management

To protect your sender reputation and maintain email deliverability:

  • We automatically track bounced emails and spam complaints through Amazon SES notifications
  • Email addresses that result in hard bounces (permanent delivery failures) will be automatically blocked from future sending
  • Email addresses that file spam complaints will be immediately added to your suppression list
  • You are responsible for maintaining clean email lists and promptly removing invalid addresses

Excessive bounce rates or spam complaints may result in account suspension to protect the deliverability of all SendLouis users.

7. Intellectual Property and Data Ownership

The Service and its original content, features, and functionality are owned by SendLouis and are protected by international copyright, trademark, and other intellectual property laws.

Your Data: You retain all ownership rights to:

  • Email templates you create or upload
  • Contact lists and recipient data
  • Email content and campaigns
  • Files and attachments you upload

By using the Service, you grant SendLouis a limited, non-exclusive license to host, store, and transmit your content solely for the purpose of providing the Service to you. We will not use your data for any other purpose without your explicit consent.

7.5. API and Webhooks

The Service provides API endpoints and webhook functionality for integration with third-party services:

  • API usage is subject to the same sending limits as your plan
  • You are responsible for securing your API credentials and webhook URLs
  • We reserve the right to rate-limit API requests to ensure service stability
  • Webhook integrations with services like Zapier and Webflow are provided as-is
  • You must not abuse or attempt to exploit API endpoints

8. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

SendLouis shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution:

  • Any disputes arising from these Terms or your use of the Service should first be addressed by contacting support@sendlouis.com
  • If a dispute cannot be resolved informally, you agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association
  • Arbitration will be conducted in English and held in the United States
  • Each party will bear its own costs of arbitration

You agree to waive your right to participate in class action lawsuits or class-wide arbitration.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
